Terms of Service

1. Agreement to Terms

By accessing or using our website, registering for programs, or participating in any Excalibur Coaching & Fitness activities, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access our services.

2. Program Registration & Payments

2.1 Registration

All program registrations are subject to availability. Completion of the registration form does not guarantee a spot until payment is confirmed and you receive a confirmation email.

2.3 Payment Terms

Full payment is required at the time of registration unless a payment plan is explicitly offered. All fees are listed in USD.

2.4 Refund & Cancellation Policy

• Cancel within 7 days of registration: Full refund (minus a 10% processing fee).
• Cancel within 48 hours of program start: 50% credit toward a future program.
• Cancel less than 48 hours before or after program begins: No refund or credit.
• Medical cancellations: Pro-rated credit provided with a doctor's note.
• Weather or facility closures: Make-up sessions will be scheduled or credit issued.

3. Participant Waiver & Assumption of Risk

I understand that participation in sports, fitness, and agility activities involves inherent risks, including but not limited to physical injury, strains, fractures, or in extreme cases, permanent disability or death. I voluntarily assume all risks associated with participation.

I certify that the participant is physically fit and has no medical condition that would prevent safe participation. I agree to disclose any relevant medical conditions (asthma, allergies, heart conditions, etc.) during registration.

In case of emergency, I authorize Excalibur staff to secure medical treatment if I cannot be reached immediately.

4. Liability Release

To the fullest extent permitted by law, I release Excalibur Coaching & Fitness, its owners, coaches, volunteers, and facility partners from any and all claims, demands, damages, or injuries arising from participation in programs, use of equipment, or presence at any facility — even if caused by alleged negligence.

This release applies to me, my child, my heirs, and my legal representatives.

5. Media Consent

I grant Excalibur Coaching & Fitness the irrevocable right to photograph, record, and use my or my child's likeness in promotional materials, social media, and website content. I waive any right to inspect or approve final products. To opt out, you must provide written notice before your first session.

6. Code of Conduct

All participants, parents, and spectators must treat coaches, staff, and other families with respect. No bullying, fighting, foul language, or unsportsmanlike conduct will be tolerated. Excalibur reserves the right to remove any participant from a session or the program without refund for code of conduct violations.

Parents agree to supervise siblings who are not registered participants.

7. Limitation of Liability

To the maximum extent permitted by law, Excalibur Coaching & Fitness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the specific program at issue.

8. Modifications to Terms

We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms. Material changes will be notified via email.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict of law principles. Any legal action shall be brought exclusively in Fulton County, Georgia.
